Prerequisites

Purpose
The purpose of the course is to give the students thorough legal knowledge about and ability to interpret and administer the Faroese constitution in a broad sense, the frame of government.
Content
The course starts with the older and the later frame of government and the differences between the two, but the main emphasis later on the later frame of government, the political background to it, and the fundamental values and theories lying behind. The course also covers the now abandoned constitutional project 1999-2018 and likely causes of its lack of success. The provisions and rules that will be covered concern the structure and division of powers and competences between the Landsstýri (government) and the Løgting (parliament), including: - The legislative process and the legislative competences of the Løgmaður and Løgting. - The rules and procedures for electing the Løgmaður. - The rules on parliamentarianism. - The ministerial system, the rules on individual Ministerial responsibility, and the provisions on the parliamentary committee reviewing ministerial conduct (Landsstýrismálanevndin) and other review bodies. Other important topics that will be covered include i.a. the rules on the public budget, tax collection and foreign policy and the relations between the municipalities and the central authorities of the Faroes.
Learning and teaching approaches
Umleið 40 tímar undirvísing á staðnum. Undirvísingin verður skipað sum fyrilestrar, kritiskt kjak, bólkaarbeiði og studentaframløgur og á annan aktivan hátt við tí lesandi í miðdeplinum. Approx. 40 hours of student time confrontation. The teaching consists of lectures, critical discussions, work in groups, student presentations and other forms of active student centered learning.
Learning outcomes
After completion of the course, the students are expected to be able to: - Explain in general the difference between the older and the later frame of government. - Explain the main substantive content of the later frame of government. - Explain what kind of legal instrument the frame of government is, how it is enacted and changed, og where it is to be placed in the constitutional hierarchy. - Explain the Faroese constitutional process 1999-2018, evaluate the reasons for its lack of success, and formulate proposals for how the process might have been differently approached. - Explicate the political, social and theoretical preconditions for the later frame of government. - Present and formulate independent perspectives on Faroese constitutional law II in concise and cohesive written and oral language.
Assessment method
A multiple choice exam in the middle of the course will count for 25% of the grade, and a written 4 hour exam at the end of the course will count for 75% of the grade. A precondition for passing the overall course is that the student has passed both exam components.
