The purpose of the dissertation is to delimit the conception of public foundations and institutions. According to a clause in the Faroese constitution, all public institutions and foundations with independent accounts must present their accounts to the Faroese Parliament, although not represented in the National Budget. The legislative history is very poor. Therefore, there has been great disagreement in the legal profession regarding the interpretations of the clause and whether a foundation or an institution is private or public. The Article discusses private and public foundations in general and administrative entities in the grey area in particular. The law concerning foundations in the Faroe Islands is not codified. The examined public foundations in the dissertation do not meet the classic criteria for foundations. Clarifying legislation for public foundations in Faroe Islands is therefore desirable.
